This Privacy Policy (the "Policy") describes how HumanlyHR Inc. d/b/a Humanly ("Humanly," "we," "us," or "our") collects, uses, and shares information when you use the Humanly JobSeeker website at https://jobseeker.humanly.io and any related products, features, and services that link to this Policy (collectively, the "Services").

The Services are separate from Humanly's business-to-business ("B2B") recruiting platform. Humanly's B2B services are governed by a separate privacy policy available at humanly.io. This Policy applies only to the Services offered directly to individual job seekers through the JobSeeker site.

If you do not agree with this Policy, please do not use the Services.

  • Who can use the Services. The Services are only for users 18 years of age or older.
  • Where we operate. The Services are offered from and operated in the United States and are only intended for users located in the United States. We do not currently target or knowingly offer the Services to users outside the United States.
  • What we collect. Account details (name, email, phone), profile information, content you provide to our AI coaches (including audio and video from practice interviews), and technical/usage data.
  • How we use it. To provide and improve the Services, to authenticate you, to personalize coaching, to keep the Services secure, to send you transactional notices and optional service-related email updates (such as potential job matches and profile reminders — you can opt out of these at any time), and to comply with law.
  • Who we share it with. A limited set of service providers and AI subprocessors listed in Section 5. We do not share your application materials, interviews, or coaching content with employers unless you explicitly direct us to do so on an employer-by-employer basis as part of our "skip-the-line" products.
  • Your choices. You can review and update most information in your Profile, opt out of non-essential communications, and — if you live in a covered US state — exercise privacy rights described in Section 12.
  • Retention. We retain your data while your account is active and for up to one (1) year after account deletion, unless a longer period is required by law.

1. Information we collect

1.1 Information you provide to us

  • Account information. Name, email address, phone number, and the one-time passcodes you submit to sign in. You may also create an account by signing in with Google; see Section 1.3 for what Google provides to us and our limited use of that information. If you use a demo account, we still log usage and device information as described below.
  • Profile information. Information you add to your Profile, such as location, resume content, education, work history, skills, job preferences, and salary expectations.
  • AI session content. Text, audio, and video you submit to or generate with our AI features, including practice interviews, career coaching sessions, and "Know your worth" conversations. This includes recordings and transcripts of your sessions.
  • Communications with us. Support requests, feedback, and other messages you send to Humanly.

We do not request or knowingly collect Social Security numbers, government ID numbers, payment card numbers, protected health information, or other sensitive financial or medical information. Please do not submit that information through the Services.

1.2 Information we collect automatically

When you use the Services, we and our service providers automatically collect:

  • Device and log data. IP address, browser type and version, operating system, device identifiers, referring and exit pages, timestamps, and crash/error data.
  • Usage data. Pages viewed, features used, clicks, and other interactions with the Services.
  • Approximate location. Derived from your IP address at a city or region level. We do not collect precise GPS location.
  • Cookies and similar technologies. See Section 6.

1.3 Information from third parties

We may receive information from third-party services you use in connection with the Services, such as:

  • Our authentication provider, which returns basic account identifiers after you verify your email or phone.
  • Google, if you choose to sign in with Google. Google returns your name, email address, Google profile picture, and a Google account identifier so we can create and authenticate your account. We only request these basic profile scopes and do not access any other Google user data (such as Gmail, Drive, Contacts, or Calendar).
  • Our SMS delivery provider, which provides delivery status for one-time passcodes.
  • Anti-abuse and fraud prevention providers.

Google API Services User Data Policy. Our access, use, storage, and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. We use Google user data only to authenticate you and to create and operate your Humanly JobSeeker account. We do not use Google user data to train artificial intelligence or generative machine-learning models, to serve advertising, or to sell or transfer that data to third parties, except as necessary to provide or improve the Services and as described in this Policy.

What we do not collect or do. We do not collect demographic data (such as race, ethnicity, gender identity, sexual orientation, or disability status), we do not enrich your Profile from external data brokers or public web sources (such as LinkedIn or Crunchbase), and we do not use referral or affiliate tracking to attribute your sign-up to any partner.


2. How we use your information

We use the information we collect to:

  • Provide, operate, and maintain the Services.
  • Authenticate you and secure your account (including sending one-time passcodes).
  • Personalize and generate AI practice interviews, coaching, and compensation guidance.
  • Store and play back your past sessions so you can review your progress.
  • Communicate with you about the Services. This includes:
    • Transactional notices required to operate your account, such as sign-in codes, security alerts, confirmations, and notices about material changes to these policies. You cannot opt out of transactional notices while you continue to use the Services.
    • Service-related email updates, such as potential job matches we think are relevant to your Profile, reminders to complete or refresh your Profile, and job-search status updates. You can opt out of service-related email updates at any time using the unsubscribe link in each message or in your account settings. Opting out of these updates does not affect transactional notices.
  • Respond to your support requests, feedback, and other inquiries.
  • Monitor, troubleshoot, and improve the Services, including debugging and analytics.
  • Detect, prevent, and respond to fraud, abuse, security incidents, and other harmful activity.
  • Comply with legal obligations and enforce our Terms of Service.

We do not sell your personal information, and we do not use your information for targeted advertising across unrelated third-party sites or apps.


3. Legal basis for processing

We process your personal information because it is necessary to provide the Services you request, to comply with legal obligations, to protect the Services and our users, and — where required — with your consent (for example, when you enable your microphone or camera for an AI session).


4. AI features and automated processing

The Services include AI-powered products including practice interviews, coaching conversations, and compensation analysis (collectively, "AI Features"). AI Features are delivered using a combination of first-party software and third-party AI subprocessors.

Subprocessors used to deliver AI Features. Depending on the feature you use, your inputs and generated outputs may be transmitted to and processed by:

Recordings, transcripts, and other AI session data generated through the Services are stored on our cloud infrastructure as described in Section 5.

We contract with these providers to process your data only to deliver the Services and not to train their own foundation models on your content, to the extent their commercial terms support it. Terms with AI subprocessors evolve; we will update this Policy as our provider list changes.

No automated decisions with legal effect. Humanly does not use AI to make employment, credit, housing, or other decisions that produce legal or similarly significant effects about you. AI Feature outputs are for your information and practice; they are not employment decisions and should not be relied on as legal, financial, or career advice.


5. When and with whom we share information

We share personal information only as described below.

  • Service providers and subprocessors. We share information with vendors that help us run the Services, under written contracts that restrict their use of your information to providing services to Humanly. These include operational vendors that provide:

    • Authentication and account management (for example, verifying your email or phone and managing session state).
    • SMS delivery for one-time passcodes and other transactional messages.
    • Hosting, storage, and compute infrastructure used to run the Services and store account data, profile data, and AI session data (including recordings and transcripts).
    • Product and web analytics used to understand how the Services are used and to measure performance.
    • AI inference and media providers, which are named in Section 4 because of their role in generating AI Feature outputs.
    • Anti-abuse, fraud prevention, and security providers.
    • Customer support, email delivery, and business operations providers (for example, to respond to your messages or send transactional email).
  • Employers — only if you direct us. The Services are for your personal use. We do not share your application materials, Profile, interviews, or coaching content with employers unless you explicitly request the share, on a per-employer basis, at the time of submission.

  • Compliance and safety. We may share information to comply with law, respond to valid legal process, enforce our Terms of Service, or protect the rights, property, or safety of Humanly, our users, or others.

  • Corporate transactions. If Humanly is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction, subject to standard confidentiality commitments.

  • With your consent. We will share personal information for any other purpose disclosed to you at the time of collection or with your consent.

We do not sell personal information for money, and we do not share personal information for cross-context behavioral advertising.


6. Cookies and tracking technologies

We use cookies and similar technologies to keep you signed in, remember preferences, measure usage, and secure the Services. Specifically:

  • Strictly necessary cookies used for authentication (via Clerk) and session state.
  • Analytics cookies and identifiers used by PostHog (product analytics; may include session replay of interactions with the Services, excluding content of AI sessions) and Vercel Analytics (aggregate web performance and traffic).

You can control cookies through your browser settings. If you disable non-essential cookies, the Services should continue to work, though some features may be degraded.

We do not use advertising cookies or pixels for cross-site behavioral advertising.


7. SMS and one-time passcodes

We use SMS for one-time passcodes (OTP) and transactional account messages only (for example, sign-in codes and important account notices). We do not send marketing or promotional text messages, and no mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with the SMS delivery subprocessor needed to deliver these messages is permitted and limited to that purpose.

Standard message and data rates from your carrier may apply. You can stop receiving non-essential messages at any time by replying STOP, and you can get help by replying HELP. Because OTP messages are required to sign in, opting out of all messages may prevent you from accessing your account.

This section applies only to SMS. See Section 2 for how we handle email communications, including how to opt out of service-related email updates.


8. Practice-interview, coaching, and session recordings

When you use AI Features that capture your microphone or camera, you will be prompted by your browser for permission. Audio and video you submit, along with transcripts and model outputs, are stored on our cloud infrastructure so you can review your sessions later.

  • Who can access recordings. You can access your own recordings from your account. Humanly personnel may access recordings only as needed to operate, support, and improve the Services, or when required by law.
  • Not shared with employers. Practice-interview and coaching recordings are never shared with employers unless you explicitly direct us to share a specific artifact with a specific employer.
  • Deletion. You can delete individual sessions from your account. Deleting your account removes associated recordings according to Section 9.

9. Data retention

We retain your personal information for as long as your account is active.

  • After account deletion, we retain personal information for no longer than one (1) year, unless a longer period is required by law or is needed to resolve disputes, enforce our agreements, or protect the safety or security of the Services.
  • Backups and logs may persist for a short additional period after deletion but are isolated from further active use and are deleted on a rolling schedule.
  • De-identified or aggregated data that cannot reasonably be used to identify you may be retained indefinitely.

10. How we protect your information

We use administrative, technical, and organizational safeguards designed to protect your information, including encryption in transit, access controls, and monitoring. No method of transmission or storage is 100% secure; please use a strong, unique password, keep your contact information current, and notify us promptly of any suspected unauthorized access.


11. Children

The Services are not directed to, and are not available to, individuals under 18 years of age. We do not knowingly collect personal information from anyone under 18. If we learn we have collected personal information from a user under 18, we will delete that information and terminate the associated account. If you believe a user under 18 has provided us information, contact privacy@humanly.io.


12. US state privacy rights

The Services are offered only in the United States. Depending on your state of residence, you may have some or all of the following rights regarding your personal information:

  • Right to know / access. Request confirmation of whether we process your personal information and obtain a copy of the information we hold.
  • Right to correct. Request correction of inaccurate personal information.
  • Right to delete. Request deletion of personal information we collected from you.
  • Right to data portability. Request a copy of your personal information in a portable format.
  • Right to opt out of sale/sharing and targeted advertising. We do not sell personal information for money and do not share it for cross-context behavioral advertising, so this right is satisfied by default; you may still submit a request for the record.
  • Right to limit use of sensitive personal information. We do not use sensitive personal information to infer characteristics about you.
  • Right against discrimination. We will not discriminate against you for exercising these rights.

These rights may be available to residents of (among others) California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia.

How to submit a request. To exercise any right, email privacy@humanly.io from the email on file for your account, or contact us using the details in Section 15. We will respond within the timeframe required by applicable law.

Verifying your request. Before acting on a right-to-know, correction, deletion, or portability request, we need to verify that the request is genuinely from you (or your authorized agent). We typically do this by matching the request against information already associated with your account, such as the email address or phone number on file, and by sending a confirmation link or code. For sensitive requests, we may ask for additional information reasonably necessary to verify your identity. If we cannot verify your request, we will let you know and may ask you to resubmit with additional details.

Authorized agents. You may designate an authorized agent to submit a request on your behalf. The agent must provide (i) written permission signed by you authorizing the agent to act on your behalf, or valid power of attorney under applicable law, and (ii) sufficient information for us to verify the agent's identity. We may also contact you directly to confirm that you authorized the request. We will deny requests from agents who cannot provide adequate proof of authorization.

Appeals. If we decline your privacy-rights request in whole or in part, you may appeal our decision by replying to our written response or by emailing privacy@humanly.io with the subject line "Privacy Rights Appeal." Please include a copy of the original request and the reason you believe the decision should be reversed. We will review your appeal and send you a written response within the timeframe required by applicable law (typically 45 to 60 days, depending on your state). If your appeal is denied, residents of certain states may be able to submit a complaint to their state attorney general; we will include contact information for your state's attorney general in our appeal response where required.

California "Shine the Light." California Civil Code § 1798.83 (the "Shine the Light" law) permits California residents to request, once per year, information about whether we disclosed personal information to third parties for those third parties' direct marketing purposes in the preceding calendar year. Humanly does not share personal information with third parties for their own direct marketing purposes. California residents who wish to make a Shine the Light inquiry may email privacy@humanly.io with the subject line "California Shine the Light Request."

We do not sell or share (as defined under California law) any of these categories. We do not use sensitive personal information to infer characteristics about you.


13. Do Not Track

Some browsers transmit "Do Not Track" ("DNT") signals. Because no common standard for DNT has been finalized, we do not currently respond to DNT signals. We will update this Policy if that changes.


14. Changes to this Policy

We may update this Policy from time to time. When we do, we will change the "Last updated" date above and, if the changes are material, we will provide additional notice (for example, by email or an in-product notice). Your continued use of the Services after the updated Policy takes effect means you accept the updated Policy.
